ACTION FILE

What to do if you or a member of staff is suffering from stress.

Employers with five or more employees have stress related duties under the Management of Health and Safety at Work Regulations.

An employer risks liability for an employee’s stress related health issues if he knows that an individual employee is suffering stress because of the demands of the job, and then does nothing about it.

These actions are not necessarily in the correct order for your circumstances so please read and note as applicable.

w

Check - Have formal stress risk assessments been undertaken? These stress risk assessments are required under the Management of Health and Safety at Work Regulation and should be completed by competent persons, i.e. Someone who has had recognised training in both the risk assessment process and stress management.

w

Check - Have the recommended stress risk minimisation measures been implemented and maintained?

w

Check - What stress policies and procedures exist? How were they created? Do they relate to a formal stress risk assessment process?

w

Check - Have the incident feedback measures been acknowledged, acted upon and where applicable resulted in revised stress risk minimisation measures?

w

Could the problems be due to bullying or other relationship issues?

w

Ensure you keep a separate diary of incidents, actions and concerns especially if bullying is either suspected or evident.

w

Is there a stress help-line or independent stress management service available?

w

Is all training up to date? If capability issues are being considered, the employer has a duty to ensure the employee has received proper training.

w

Has this stress issue suddenly appeared? Are there circumstances outside or work that could be contributing to the problem?

w

Are there common issues, e.g. similar incidents involving others working with the same particular person or group of people?

w

Have duties or responsibilities suddenly been changed which, regardless of previous training, are causing capability issues.

w

If capability issues are evident, does evidence exist that proves capability to undertake equal duties prior to this time?

w

Are the school’s absenteeism, sickness and accident records above or below the national average?

w

Have there been previous cases of stress in this school?

w

Could discrimination due to sex, age, race, religion, sexual orientation, etc. be an issue?

These are all questions a Professional Stress Manager will ask if called in to help or act as an expert witness. That Professional Stress Manager could be acting on behalf of the school or the complainant!
